The Employment Department acts mainly for an employer base advising in respect of all aspects of employment work.

Clients benefit from employment specialists advising on drafting contracts and policies to defending and prosecuting claims in the Employment Tribunals and Courts. All members of the Department provide expert and pragmatic advice to HR professionals on employment issues including assisting with preparation of correspondence, guidance notes etc.

The Department specialises in breach of contract, disability discrimination, race discrimination, sex discrimination, unfair dismissal and transfer regulations.

Non-Contentious Employment Work

The Department has wide-ranging experience preparing contractual documents, staff handbooks and policies for a variety of industries. The Department is also very experienced in the preparation of service agreements for senior executives and directors, having developed expertise in the drafting of bespoke restrictive covenants for individuals in a wide range of industries. In addition, all members of the Department deal with the drafting and negotiation of documents entered into upon the termination of an employment relationship, including compromise agreements, consultancy agreements and deeds of covenant.

Contentious Employment Work

The Department regularly deals with all types of claim pursued in Employment Tribunals, from unfair dismissal claims to equal pay claims and multi-applicant applications made pursuant to the Transfer Regulations. Depending upon the client's needs, the Department will run a Tribunal from start to finish (including representation before the Tribunal) or, if preferred, deal with particular aspects of preparation. The Department always provides advice which takes account not only of the merits of a particular claim but also the financial and HR implications of pursuing a case to a full hearing. In addition, the Department is experienced in pursuing and defending wrongful dismissal actions in both the Tribunal and County Court and has particular expertise in dealing with interlocutory injunctive work arising out of breach of restrictive covenants and confidentiality clauses.

Transfer Regulations

The Department regularly advise vendors, purchasers and investors upon the application of the Transfer Regulations on any sale or purchase of a business as a going concern. This includes advising upon both individual and collective rights and the preparation of documents to ensure that parties comply with all their obligations and, in particular, the collective consultation process. Advice on the Transfer Regulations is also given to both "clients" and "contractors" in the context of outsourcing.
